Photoshop Express, or give away your photos to Adobe

Since Adobe announced it would launch an online version of Photoshop feel cuiriosidad to see that it works. Surely not a product that will serve me much, I have always doubted to be able to use layers, advanced filters, and end up generating TIF files of 200 MB, but can be a very valid solution to make a quick adjustment a JPG, curves, levels and tones. We finally released the first beta of Photoshop Express and I have started to take a look. The trouble is I do not like anything conditions of use.

Article 5 of these conditions Adobe includes a copyright notice, which allows users to copy and print service photos of anyone else but only for personal use and do not modify or redistribute. It looks very good idea to remove a default protection rights that every image is taken from the time, but at least every author can re-assert their rights, because in that article includes the tagline "unless otherwise indicated on additional conditions. "

A little further down I'm surprised the title of Article 8: "Using your content." If you read it you will find that Adobe is granted any rights on your photos. Not on all, but if you put on the public area. Thanks to this article will Adobe a worldwide, free and clear, non-exclusive (lucky, at least I can still use my photos without me to claim anything Adobe), perpetual, irrevocable, and fully sublicensable license to use, distribute, income, reproduce, modify, adapt, publish and do whatever they want with your photos, including modifying and selling them to others.

Already definitely a place I will not upload any photo. And not because they have no special value, but because it is an abuse in the making. Imagine you do a picture of a spectacular landscape. Spend several days to find the perfect moment, the right light, the clouds on the site you want ... You do it as a hobby and not going to sell, but one day you find it on billboards throughout the city as an image of million dollar campaign. ¿Millionaire for whom? Why Adobe for advertising agency? Certainly not for the author, who does not even recognize him including his name.

Moreover, even snapshots of your vacation or holiday of your children could end up resold to third parties for purposes unknown, for you have given all rights of use. It's already happening with the photos posted on Flickr , as the case of Lara Jade , or the Hel Des despite having rights reserved. In this case it would be defensible to report the case and show that they have no right to such use, but what if you have previously agreed to cede almost all the rights?

I just discovered your blog and already I'm linking ... you can not complain. :)

Tremendous these conditions of use ... My question now is whether I missed the fine print on other services like Flickr.

Thanks Bruno, I have yet to link to yours, in advance a little further short course of Peleng ;-)

It definitely has been to me, but I know where I've had so far not had these conditions, and Flickr never finished like me, so I'm not registered ...

The same day 27 and had a response from Adobe had not seen. It seems that "was not what they wanted to say" and its lawyers are reviewing the clauses in a hurry. I look forward to see that actually meant.
